This Privacy Policy explains how Qart (“Qart,” “we,” “us,” or “our”) collects, uses, stores, discloses, and otherwise processes personal information when you access or use the Qart website, products, services, features, content, and related functionality (collectively, the “Service”).

The Service is operated by Creative Pandem, LLC.

By using the Service, creating an account, or otherwise interacting with Qart, you acknowledge the practices described in this Privacy Policy.

2. Scope of This Privacy Policy

This Privacy Policy applies to personal information we collect when you:

  • visit or use the Service;
  • create or use a Qart account;
  • purchase or manage a subscription;
  • create, publish, or manage QR content or landing pages;
  • interact with public Qart pages;
  • contact us for support or other inquiries;

This Privacy Policy does not apply to third-party websites, services, or platforms that may be linked through QR pages or otherwise integrated with the Service. Those third parties have their own privacy policies and practices.

3. Personal Information We Collect

We may collect the following categories of personal information.

A. Account and Profile Information

When you create or use a Qart account, we may collect:

  • email address;
  • name;
  • profile image;
  • authentication provider;
  • account or user identifier;

If you register using email and password, Qart may require email verification before activating or enabling certain account functionality. If you register using Google or another supported third-party provider, authentication is handled through that provider.

B. Subscription and Billing Information

If you purchase or manage a paid plan, we may collect or receive:

  • plan name;
  • billing cycle;
  • subscription status;
  • payment status;
  • invoice-related information;
  • Stripe customer ID;
  • Stripe subscription ID;

Qart does not store full payment card numbers. Payment card information is processed by third-party payment providers such as Stripe, subject to their own terms and privacy practices.

C. User Content

When you use the Service, we may collect and process content you upload, submit, or publish, including:

  • text;
  • images;
  • links or URLs;
  • QR landing page data;
  • other content you choose to make available through the Service;

D. Usage and Unique Scan Information

When you use the Service or when someone visits a public Qart page or scans a QR code associated with the Service, we may collect:

  • unique-scan identifier or similar identifier;
  • QR scan events;
  • IP address;
  • user agent;
  • country;
  • city;
  • timestamps;
  • usage information related to plan limits and unique-scan counting;

Qart uses this information to measure unique scans, apply subscription plan limits, prevent duplicate counting where appropriate, and display related usage information to account holders.

E. Interaction Information

We may collect information about your interactions with the Service, including:

  • likes on artistic QR content;
  • saved or favorited items;
  • support or communications you send to us;

F. Communications Information

If you contact Qart, we may collect:

  • your email address;
  • the contents of your message;
  • records of support, account, billing, or privacy-related communications;

4. How We Use Personal Information

We may use personal information for the following purposes:

  • creating and managing accounts;
  • authenticating users and protecting account security;
  • providing password reset and login-related functionality;
  • operating, delivering, maintaining, and improving the Service;
  • hosting, processing, and displaying user-generated content;
  • providing QR features and related usage reporting;
  • measuring unique scans and applying subscription plan limits;
  • sending service-related notices and operational communications;
  • processing subscriptions, billing, renewals, and related customer support;
  • detecting, investigating, and preventing fraud, abuse, unauthorized access, and other harmful activity;
  • enforcing our Terms and other policies;
  • complying with legal obligations;
  • responding to support, privacy, and intellectual property requests;

Qart may also send service notifications, including notices when subscription usage approaches or reaches plan thresholds such as approximately 70%, 80%, 90%, and 100% of applicable plan limits.

Qart does not currently send promotional marketing emails as a regular part of the Service, but we may do so in the future in accordance with applicable law and user preferences.

5. Cookies and Similar Technologies

Qart uses cookies and similar technologies for purposes such as:

  • login and session functionality;
  • security and abuse prevention;
  • remembering service-related preferences;
  • measuring unique scans;
  • applying subscription or plan-limit usage rules;
  • showing related usage information within the Service;

Qart currently uses cookies and similar technologies primarily as part of the core operation of the Service, including unique-scan counting and plan-limit enforcement.

Qart does not currently describe these technologies as separate advertising cookies or optional analytics cookies. If Qart introduces non-essential cookies or similar technologies in the future, we may update this Privacy Policy and our Cookie Policy and, where required by applicable law, request consent.

6. Sources of Personal Information

We may collect personal information:

  • directly from you;
  • automatically when you use the Service or interact with public Qart pages;
  • from authentication providers you choose to use, such as Google;
  • from payment providers such as Stripe;
  • from service providers that help us operate the Service;

7. When We Share Personal Information

We do not sell your personal information. We may share personal information in the following circumstances:

A. Service Providers and Vendors

We may share information with service providers that help us operate Qart, including providers related to:

  • authentication and database infrastructure;
  • payment processing;
  • transactional email and support communications;
  • hosting and deployment;
  • storage and content delivery;
  • security and abuse prevention;

These service providers are authorized to process personal information only as necessary to provide services on our behalf and in accordance with applicable data protection laws.

We may also use service providers related to security or anti-abuse measures, such as Google reCAPTCHA, if enabled or used in a given part of the Service.

B. Public Content

If you publish public content or make QR pages publicly available, that content may be visible to other users or visitors, including anonymous visitors.

Although Qart intends public Qart pages to be noindexed, we cannot guarantee that third parties will never access, cache, archive, or retain public material once it has been made available online.

C. Legal Compliance and Protection

We may disclose information if we believe doing so is necessary or appropriate to:

  • comply with applicable law, regulation, legal process, or governmental request;
  • enforce our Terms or other agreements;
  • protect the rights, property, safety, or security of Qart, our users, or others;
  • detect, prevent, or address fraud, abuse, security, or technical issues;

D. Corporate Transactions

We may disclose or transfer information in connection with a merger, acquisition, financing transaction, reorganization, bankruptcy, sale of company assets, or similar corporate event.

8. International Processing

Qart is offered worldwide. Your personal information may be processed, stored, or accessed in countries other than your own, including the United States and other jurisdictions where Qart or its service providers operate.

By using the Service, you understand that your information may be transferred to and processed in jurisdictions that may have data protection laws different from those of your country of residence.

9. Data Retention

Qart retains personal information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, enforce agreements, and protect the Service.

In general, Qart may apply the following retention practices:

  • Deleted account data: retained for up to 30 days after a confirmed deletion request, unless longer retention is required for legal, accounting, fraud-prevention, security, or dispute-resolution purposes.
  • Public pages and public QR content after account deletion: removed as soon as reasonably practicable after the deletion request is processed.
  • Raw IP address data: generally retained for up to 30 days, unless longer retention is reasonably necessary for abuse prevention, fraud investigation, legal compliance, or security purposes.
  • Unique-scan and related usage data: may be retained for up to 12 months, and may be retained longer in aggregated, de-identified, or otherwise non-personal form.
  • Billing, invoice, refund, subscription, accounting, and dispute records: retained for as long as reasonably necessary for legal, tax, accounting, auditing, and dispute-resolution purposes.

Retention periods may vary where necessary to comply with applicable law, resolve disputes, enforce agreements, or protect Qart and its users.

10. Account Deletion

Qart does not currently provide self-service account deletion through the website.

If you want your account deleted, you may contact us at [email protected]. When Qart processes a confirmed deletion request:

  • the applicable subscription will be canceled;
  • public pages associated with the account will be removed as soon as reasonably practicable;
  • certain data may be retained for a limited time or longer where necessary for legal, accounting, fraud-prevention, security, or dispute-related purposes;

11. Your Privacy Choices and Rights

Depending on your location and applicable law, you may have certain rights regarding your personal information.

Qart currently supports requests to:

  • access personal information we hold about you;
  • correct inaccurate personal information;
  • request deletion of your personal information;

If Qart introduces non-essential cookies or similar technologies in the future and relies on consent where required by applicable law, users may also be able to withdraw that consent through available controls.

Qart may limit or decline a request where permitted by law, including where the request is technically infeasible, would adversely affect the rights of others, or where Qart has a lawful basis to retain certain information.

12. Children’s Privacy

Qart is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13.

13. Security

Qart takes reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, or destruction.

However, no method of transmitting or storing data is completely secure, and Qart cannot guarantee absolute security.

14. Third-Party Services

The Service may rely on or integrate with third-party providers such as authentication, payment, email, hosting, storage, and security providers. It may also link to third-party websites or services through QR destinations or user content.

Those third parties operate under their own terms and privacy practices, and Qart is not responsible for their privacy or data handling practices.

15. Changes to This Privacy Policy

Qart may update this Privacy Policy from time to time. If we do, we may update the “Last Updated” date and post the revised version on the website.

Your continued use of the Service after an updated Privacy Policy becomes effective constitutes your acknowledgment of the updated policy, to the extent permitted by applicable law.
